Inside the industry
Running a fund or a licence means living with ASIC’s regulatory guides, fund tax regimes and AUSTRAC, while still building the business. We help on the numbers side.
Responsible entities, custodians and other AFS licensees face net tangible assets, liquidity and cash flow projection requirements under RG 166, with the auditor checking them each year. We build cash flow projections and monitoring your board can rely on.
AFS licensees must report reportable situations to ASIC within 30 calendar days, including significant breaches and investigations that run longer than 30 days. We help set up breach registers and escalation that work in practice.
TMDs need review triggers, distribution conditions, complaint and sales data, and records that show you followed them. ASIC has used stop orders where TMDs were too broad.
Accountant’s certificates based on $2.5 million net assets or $250,000 gross income in each of the last two years expire after two years, and the thresholds have been under review. We prepare certificates properly and help you keep evidence on file.
The attribution managed investment trust (AMIT) regime, fair and reasonable attribution, unders and overs, AMMA statements, and MIT withholding on fund payments to foreign investors (generally 15% for information-exchange countries).
A unit trust that carries on or controls a trading business can be taxed like a company under Division 6C, losing flow-through treatment. We review the fund’s activities and structure before a new strategy goes live.
Founders often have most of their wealth in one management company. Timing of performance fees, equity in the manager, holding structures, super and diversification all matter. We plan your personal wealth alongside the business, with honest risk profiling.
AFS licensing, financial requirements (RG 166), breach reporting, design and distribution obligations, and disclosure.
AMIT and MIT status, withholding, Division 6C, CRS and FATCA reporting, and investor statements.
